1. Service Description
MailProof provides a certified email delivery service. Emails sent through MailProof are routed via a certified relay that records the SMTP delivery chain. A delivery certificate is issued upon confirmed server acceptance.
2. Scope of Certification
Delivery certificates confirm that an email was accepted by the recipient's mail server. Where the recipient's email client supports it, MailProof also tracks when an email is opened and records this as a "read" event with a timestamp. However, some email clients block tracking, so the absence of a read event does not mean the email was not read. Read tracking is provided as additional evidence where available, not as a guarantee.
3. Identity and Content
MailProof does not verify the identity of account holders beyond email verification. The account holder is solely responsible for the accuracy, legality, and content of all emails sent through the service. MailProof accepts no liability for the content of messages, attachments, or email footers.
4. Email Footer
Account holders are strongly encouraged to configure an email footer containing their full name, organisation, and contact details. This footer is appended to every certified email and helps recipients verify the sender's identity. MailProof is not responsible for incomplete or inaccurate footer information.
5. Limitation of Liability
MailProof is provided "as is" without warranty of any kind. MailProof shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the service, including but not limited to reliance on delivery certificates in legal proceedings.
6. Acceptable Use
You agree not to use MailProof to send unsolicited bulk email (spam), fraudulent, threatening, defamatory, or unlawful content. MailProof reserves the right to suspend or terminate accounts that violate this policy without notice.
7. Data Retention & Encryption
MailProof retains email metadata, delivery records, and certificates for the purpose of providing the service. Message content (subject and body) is encrypted at rest using AES-256-GCM and is only accessible to the account holder. All data in transit between MailProof servers is protected by TLS 1.3 with AES-256 encryption. MailProof does not share user data with third parties except as required by law.
8. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
